The FC Talent Code and Standards for Performers
 

DEFINITIONS

AGENCY
The individual or Corporation tasked with the general representation, procurement of work, management of information and work-related assistance/advising of the background Performer as it pertains to the entertainment industry. 

PERFORMER
An individual either seeking representation or currently represented by the Agency via verbal and/or written contract, within the entertainment industry.

PRODUCTION
The company, corporation, organization and/or their representatives that controls, administers, directs, and is responsible for the hiring of Performers, whether or not he, she, or it is or will be an owner of copyright of the finished product.
 

The Agent/Performer relationship is not considered an employer/employee relationship.  The Performer is considered a self employed contractor, employed by Production and/or their representatives.

 

GENERAL

  • FC Talent celebrates diversity within our roster, the entertainment industry and our world.  All Performers should be able to work without fear of harassment or violence, in a safe and healthy environment.  This includes sexual, racial, or personal harassment and violence.  With that said, The Agency holds a zero tolerance policy for any form of harassment, which includes sexual, racial or personal harassment and violence.  FC Talent will accept no less than 100% agreement and compliance with this zero tolerance policy.  In the event that a Performer is experiencing discrimination and/or harassment while on set, the Performer must speak with a Production representative, ACTRA representative and relay this information to the Agency.  Additionally, Performers who engage in any types of discrimination while on set or at any point while being represented by the Agency will be removed from the roster immediately. 
     

  •  It is understood that professionalism is of paramount importance while working with the Agency.  Additionally, words and actions on set are not only a reflection of yourself but also the Agency and other representatives who work on your behalf in the entertainment industry.  By working with FC Talent, it is understood and agreed that you will conduct yourself in a professional manner at all times.
     

  •  If at any time there is a disagreement or dispute on set between Production and Performer, the Performer will contact the Agency at the soonest reasonable time to assist in the resolution of the disagreement or dispute. The Performer will always remain professional throughout any ongoing disagreement or dispute, both in person and while off set.
     

  • In the event of an injury on set which involves the Performer, it is to be reported immediately to Production.

 

PRE-BOOKING

 Prior to working with FC Talent, the Performer will fulfill his/her obligations which include:

  • Completion of Ontario Health & Safety Certificate with both digital and paper copies available for submission on the day of work and having available all required Ontario Residency documents.
     
     As per IPA A609d (excerpt), "A Background Performer who fails to furnish appropriate residency information or proof of completion of Ontario Health & Safety training by his or her call time on his or her first day of engagement may be cancelled and replaced immediately."
     

  • Full understanding, acceptance and payment of any required Registration amounts, outstanding Agency fees, commissions and penalties prior to accepting work.  Additionally, it will be understood that by accepting work with FC Talent, the Performer fully agrees to the Agency fees, commissions and penalties and is required to comply with the rules that dictate said fees, commissions and penalties.
     

  • The disclosure of information pertaining to any past bookings on the Production that the Agency is attempting to book the Performer on.  This information includes the last date of work on that specific Production and what role the Performer was booked as.
     

  •  Disclosure of any prior conflicts with the Production that the Agency is attempting to book the Performer on.  Failure to disclose prior conflicts at the time of booking that results in a forced cancellation may result in fees and affect future work opportunities.
     

  • Ensuring the Agency has the most current measurements and photos to accurately reflect the Performer's current look.

  • Securing a means of transportation OR refusal of work if the Performer is unable to travel to the studio or location for a consecutive booking in a safe manner by him/her self.


INTRA-BOOKING

  • It is understood that upon acceptance of a Booking, the Performer agrees to maintain availability for the entire day and for the duration of the booking.  A Performer must not have any commitments for the duration of that day. Should a Performer cancel a booking, fees will apply. Additionally, any Performer who misses a mandatory COVID test will be considered a “no-show” and associated fees will apply.
     

  • Upon receipt of the Booking confirmation email, The Performer agrees to send the Agency an email to acknowledge confirmation in a timely manner.  Failure to confirm information may result in a forced cancellation and any associated fees.
     

  • The Performer agrees to represent him/herself honestly and accurately as it pertains to skills that may be required for a Booking, so as not to overstate his/her abilities and potentially cause Production delays.
     

  • A Performer shall not be required to have his/her appearance heavily modified on set, unless this has been communicated and agreed to prior to a booking.  Heavy modifications may include a full head shave, eyebrow removal, etc.  However, reasonable adjustments to the Performers appearance such as a trim/cleanup of Performers hair may be made if requested by Production.  
     

  • A Performer has the right to refuse to work in an unsafe working condition, as defined by the IPA.

    A Performer must abide by all applicable Agency Standards upon arriving to set, which includes:

    • Arrival to set/location/shuttle pickup location no less than 15 minutes prior to the given call time.

    • Accurate completion of work voucher (which includes items such as fittings, turnaround, etc) for ACTRA members.

    • Having all required wardrobe available and ready for approval by background wardrobe coordinator(s), upon request.  

    • Communication between Performer and Assistant Director/Production representative when stepping off set.  Unless there is an emergency on set or otherwise directed, the Performer may not leave set without informing a Production representative.

    • Informing the Agency upon receiving any performance category upgrade on set, such as ACTOR/STUNT.  The Performer must contact the Agency at the soonest reasonable time to do so.

    • The Performer being aware of his/her surroundings while on set and respecting the set and AD team.  This includes being mindful of the specific action(s) given to the Performer by the AD, and the noise level in between takes.  

    • Being aware of handheld/wearable technology.  All phones/watches, etc must be on SILENT or airplane mode while on set.  To avoid problems that can result in the disruption of a take and your possible wrap, it is advised that the above items be left in a secure location in BG holding, or left at home. 

 

POST-BOOKING

  • All ACTRA Performers (Apprentice & Full members) who send their checks to their home address agree to send clearly scanned or photographed paperwork which includes the voucher, TRS and/or contract as soon as it is received, no later than 30 business days from the booking date. Additionally, payment must be sent no later than 72 hrs from the time of receiving the check. The performer understands that late fees will be added to the outstanding balance, should these requirements not be adhered to.
     

  • The ACTRA Performer agrees to pay commission or other related amounts listed on their invoice, no later than 72 hours from receiving the invoice and no later than 30 days from the date of work. Additional line items include but are not limited to per diem, travel, wardrobe, pets.
    The ACTRA Performer understands that should payment not be made within this timeframe, they will be removed from the roster and additional loss of work may result.

  • The Non-Union/AABP Performer agrees to pay commission or other related amounts listed on their invoice, no later than 72 hours from receiving the invoice and no later than 30 days from the date of work. Additional line items include but are not limited to per diem, travel, wardrobe, pets.
    The Non-Union/AABP Performer understands that should payment not be made within this timeframe, their Membership status may be revoked, the standard commission rate will be charged on all outstanding invoices and additional fees/loss of work may apply.

  • If the Performer upon review of the paperwork discovers an error in pay, the Performer will send FC Talent all relevant paperwork, pay the invoice (if applicable) and inform FC Talent of the pay discrepancy/errors. It is the Performers decision to either inquire directly with Production OR have FC Talent inquire on my behalf to resolve the pay discrepancy/errors.
